Privacy Policy

The Little Gym International, Inc. (“TLGI” or “we,” or “us”) respects the privacy concerns of visitors to the www.thelittlegym.com, www.thelittlegymfranchise.com, and www.childrenssuccess.com websites operated by TLGI (“TLGI websites”). We want you to know: (i) the information that we collect; (ii) the steps we take to protect the information that you provide us; (iii) how we use that information; and (iv) when we share it with others.

Generally, we may collect from you the information that is described below, and use it for the purposes described below. You can limit the information that you provide us by not submitting the online request forms described below, in which case you will not be eligible for the service requested in the form.

This Privacy Policy only applies to the TLGI websites and does not apply to, and TLGI is not responsible for, the privacy policies or practices of websites operated by others, even if they are linked to TLGI websites. If you choose to link to or from another Web site to or from the TLGI websites, you should refer to that other Web site’s privacy policy and practices.

This policy does not apply to user posts or other third party content, including, for example, posts to our Facebook or other social media site, or posts to www.childrenssuccess.com. However, we may attempt to bind such third party contributors to our policies posted on such sites. We do not promise to keep such third party content private, or to keep private the identity of such third party contributors.

Each The Little Gym® location is independently owned and operated by a franchisee and TLGI cannot guarantee compliance by all franchisees with this Privacy Policy, although TLGI will attempt to require franchisees to comply.

I. Information We Collect Automatically

If you visit the TLGI websites or download information we will automatically collect certain information (“Log Information”). This Log Information may include the:

  • Name of the domain and host from which you access the Internet;
  • Internet protocol (IP) address of the computer you are using;
  • Browser software you use and your operating system;
  • Date and time you access any of the TLGI websites;
  • Internet address of the Web site from which you linked directly to any of the TLGI websites;
  • Your geographic location;
  • The pages of the TLGI websites that you visit and the time of your visits; and
  • Aggregated information that cannot be used to specifically identify you when you use or visit the TLGI websites.

A “cookie” is a small data file that a Web site can place on your computer for record-keeping, administration, or to customize your experience. Other similar technologies that we use are web beacons and pixels. Cookies and other technologies permit us, franchisees, and selected marketing partners to customize and enhance your experience on our websites and their websites. For example, if you select the “Make This My The Little Gym Homepage” feature on a franchisee Web site, the software will place a cookie on your computer so that the next time you type www.thelittlegym.com, you will be directed to your selected franchisee Web site. You may block or remove cookies on your computer by following the instructions on your Web browser.

TLGI may use the Log Information, cookies, and other technologies to manage and improve the websites; to analyze customer and prospect trends; to track inquiries and purchases; to develop and contact you about products, services and promotions; to enforce our Terms of Use; to protect TLGI’s legal rights, or those of its customers and franchisees; and for purposes required by law.

We may use cookies and other technologies to deliver information and ads to you that better match your interests.

We currently use analytics to give us information about users and their experience on the site, to administer the site, to learn about visitor behavior and demographics, and to improve our communications and services.

Third parties may collect personally identifiable information about an individual user’s online activities over time and across different Internet services when a user uses the TLGI websites. At this time, we do not respond to “Do Not Track” signals sent from Web browsers or other mechanisms that provide users the ability to exercise choice regarding the collection of personally identifiable information about a user’s online activities over time and across third party Internet services. However, users can use My Account to change contact preferences.

II. Personal Information You Choose to Provide to Us

A. Enrollment Information:

If you wish to enroll your child, you may do so either: 1) In person at franchisee The Little Gym location; or 2) By using the http://www.TheLittleGym.com/find-a-gym page on the TLGI websites, select a location and then either a) send an email to the franchisee listed which includes personal information such as your name, ages of your children, and your contact information or b) use the online enrollment feature.

These pages may collect and send to us or to our franchisees similar information (collectively “Enrollment Information”). (The Little Gym® locations are generally independently owned and operated by a franchisee.) Your Enrollment Information may be used for the same purposes as Log Information as described above, and as follows:

1. The franchisee may retain your Enrollment Information to contact you about: (a) enrolling your child; (b) upcoming classes, products and services, and promotions.

2. TLGI may also retain your Enrollment Information for these same purposes, and may send you information about franchise opportunities. We also use this Enrollment Information to improve the usefulness of our websites, to communicate with you about our franchisee classes, events, promotions, and franchise opportunities.

3. TLGI may also share your Enrollment Information with third parties, but only as described in this Privacy Policy. TLGI may share your Enrollment Information with its selected marketing partners, who might be independent companies that may join us in promotions aimed at families with children. We will attempt to prohibit our marketing partners from using your Enrollment Information except to the extent necessary to fulfill their services to you, to franchisees, or to us. We may also share your Enrollment Information with other third parties, for example, when we need to share such Enrollment Information to: (a) fulfill promotional obligations; (b) process your credit card; (c) provide a product or service you have requested; (d) manage data or host a Web site; (e) respond to court orders; or (f) administer or enforce our websites’ Terms of Use.

4. We may also collect Enrollment Information, and combine it with other information, such as that collected at franchisee locations, from public sources, your Log Information, Member Milestone (customer loyalty rewards) program information, and online purchases in the future. We may use this combined personal information for the purposes described in this Privacy Policy. If you choose not to provide the information that we request, you may not be able to participate or purchase the relevant product or service.

B. Referral Information:

If you know a parent who would be interested in learning more about The Little Gym®, you may refer him or her to TLGI by completing the Refer a Friend form on our websites. TLGI or the franchisee may use the referral information that you provide to notify the referred parent of your referral and for the other purposes described in this Privacy Policy.

C. Prospective Franchisee Information:

If you are interested in learning about franchise opportunities with TLGI, you may complete the form at http://www.thelittlegymfranchise.com. If you choose to do so, TLGI will collect your personal information on the form. This form is not an application for consideration as a franchisee. TLGI may later send you an application form that collects additional information, including financial information such as an estimate of your available liquid capital and approximate net worth (collectively “Prospective Franchisee Information”). TLGI will not sell, rent, or otherwise disclose the Prospective Franchisee Information you provide without first obtaining your consent. However, if you are an employee of a current TLGI franchisee, we may communicate the fact of your application to your current franchisee employer.

D. Resume Information:

If you’re interested in working at a The Little Gym® location, you may send to any franchisee your resume by email or regular mail to the addresses posted on the careers page located on each franchisee Web site. (Franchisees’ The Little Gym businesses are each independently owned and operated.) If you send information to TLGI about your interest in employment at a franchisee’s site, we may forward that information to the franchisees located near you, but it will not rent, sell, or otherwise disclose the information. If TLGI sends your information to a franchisee, TLGI will ask the franchisee to not rent, sell, or otherwise disclose the personal information in your resume to any third party, but cannot guarantee that the Franchisee will not do so.

III. General Privacy and Security Policy

A. Business Changes

If we become involved in a merger, acquisition, sale of assets, joint venture, securities offering, bankruptcy, reorganization, liquidation, dissolution, or other transaction or if the ownership of all or substantially all of our business otherwise changes, we may share or transfer your information to a third party or parties in connection therewith.

B. Children’s Privacy Our websites is not for children under the age of 18. We will not knowingly collect personally identifiable information from anyone under the age of 18, and if we discover that we have accidentally done so, we will delete it. Children under the age of 18 must ask a parent or guardian to provide us any personal information online.

C. Security of Online Payment and Other Data

We care about the security of your personal information, and when you submit personal information, such as credit card information or child information, that information is encrypted and protected by Secure Sockets Layer Protocol (SSL) encryption technology and stored on our servers. However, no transmission over the Internet and no electronic data storage method is 100% secure. Therefore, we cannot guarantee the absolute security of the personal information you provide to TLGI either during its transmission or its storage on TLGI’s systems. If you believe that the security of your data has been compromised, please notify TLGI immediately, and if it involves your credit card, immediately notify your credit card company in accordance with their policies.

We reserve the right to modify, alter, or update this Privacy Policy at any time, so we encourage you to review this Privacy Policy frequently in this space. This Privacy Policy is also subject to our Terms of Use posted at the TLGI websites. This Privacy Policy was last updated July 15, 2016.

IV. Acceptance of this Privacy Policy

By providing personal information to a TLGI or a franchisee, you consent to the collection, use and disclosure of that information in accordance with this Privacy Policy.
